You should file your claim in the county where the transaction or occurrence took place, where the obligation was incurred, where the Defendant resides, or has his/her place of employment. In Landlord Tenant cases, the claim must be filed where the real estate is located.
At the time you file your claim, you will be required to pay certain court costs and fees. If filing pro se, you must pay a $97 filing fee, plus $10 for each additional defendant, plus an additional $28 for sheriff service. If e-filing, you must pay an $87 filing fee, plus an additional $28 for sheriff service, but no fee for additional defendants. (If Defendant(s) are served by a Sheriff’s Department outside of Johnson County, an additional fee may be charged.) THE CLERK’S OFFICE DOES NOT ACCEPT PERSONAL CHECKS. The Clerk will accept cash, money orders, certified funds, and debit/credit. Money orders and certified funds should be made payable to the Johnson County Clerk. Service by Marion County Sheriff’s Department requires a $13.00 money order made payable to Marion County Sheriff’s Department. If you choose to use debit/credit as a means of payment, there will be a 3.5% charge to the card that is non refundable to you.
You cannot request more than $6,000.00. If you are entitled to more than $6,000.00 you automatically give up your right to all amounts over $6,000.00 by filing your case in the Small Claims Division.
